1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the Radio Free America website at radiofreeamerica.press (the "Site") and any services offered through the Site, including the RFA Wire submission service. The Site is operated by Rooted Creative Group LLC ("RFA," "we," or "us"), a California limited liability company.
By accessing the Site or submitting to the Wire, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Site or submit to the Wire.
2. Use of the Site
You may use the Site for lawful purposes consistent with these Terms. You agree not to:
- Use the Site to transmit spam, malware, or other harmful content
- Attempt to access systems or data you are not authorized to access
- Scrape or systematically harvest content for use in competing services without written permission
- Impersonate any person, organization, or entity in connection with any submission or inquiry
- Use the Site in any way that violates applicable federal, state, or local law
RFA reserves the right to terminate access for any user who violates these Terms or uses the Site in a manner we determine to be harmful to the publication, its sources, or its readership.
3. Content Ownership & Copyright
All original journalism, editorial content, design, and code on this Site is the property of Rooted Creative Group LLC and is protected by copyright. You may share links to our articles freely. You may quote up to 150 words with attribution and a link back to the original. Republication of full articles requires written permission from RFA.
Wire submissions remain the intellectual property of the submitting organization. By submitting, you grant RFA a perpetual, royalty-free license to publish, archive, distribute, and index your submission. See Section 4 for full wire terms.
4. Wire Submission Terms
4.1 What the Wire Is
The RFA Wire is a paid distribution service that allows organizations — nonprofits, civil society groups, government agencies, labor unions, businesses, and others — to submit press releases and public-interest announcements for publication on radiofreeamerica.press and distribution to our readership.
4.2 Submitter Warranties
By submitting to the Wire, you represent and warrant that:
- You are authorized to submit on behalf of the named organization
- All factual statements in your submission are accurate and truthful to the best of your knowledge
- Your submission does not infringe the copyright, trademark, or other intellectual property rights of any third party
- Your submission does not contain defamatory, fraudulent, or legally prohibited content
- You have the right to grant RFA the license described in Section 3
4.3 Editorial Discretion
RFA is a journalistic publication, not a neutral wire service or bulletin board. We reserve the right, in our sole editorial discretion, to:
- Decline any submission for any reason, including content we find inconsistent with our editorial mission
- Add an editor's note to any published submission clarifying context, disputed facts, or RFA's editorial position
- Remove any published submission following discovery of material inaccuracies, legal concerns, or other editorial grounds
- Categorize and headline submissions as we see fit for publication
Payment of a wire submission fee does not guarantee publication.
4.4 RFA as Publisher
Wire submissions published on this Site are published by Radio Free America as a journalistic publisher exercising editorial judgment. RFA is not acting as a mere conduit or neutral platform. Submissions published with an editor's note or in a clearly labeled "Wire" section are attributed to the originating organization and are not RFA's own reporting unless otherwise stated.
5. Refund Policy
Wire submission fees are non-refundable after a submission has been published. Before publication, refund requests will be considered at RFA's editorial discretion. To request a refund prior to publication, contact legal@radiofreeamerica.press with your submission reference number. Refunds are not available for submissions declined on editorial grounds after submission review has begun.
6. No Legal Advice
Nothing on this Site constitutes legal advice. RFA's journalism covering courts, legislation, civil liberties, and government is informational and for public interest purposes only. It is not a substitute for consultation with a licensed attorney. Do not rely on anything published on this Site as legal guidance for your specific situation.
7. Third-Party Links
The Site may contain links to external websites, documents, and sources. RFA is not responsible for the content, accuracy, or privacy practices of third-party sites. Links to external sources do not constitute endorsement.
8. Disclaimer of Warranties
The Site and all content are provided "as is" without warranties of any kind, express or implied. RFA does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. To the maximum extent permitted by applicable law, RFA disclaims all warranties, including implied warranties of merchantability and fitness for a particular purpose.
9. Limitation of Liability
To the maximum extent permitted by California law, Rooted Creative Group LLC, its officers, members, employees, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, data loss, or reputational harm — arising from your use of or inability to use the Site, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim, or $100, whichever is greater.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in California's Central Valley, and you consent to personal jurisdiction in those courts.
11. Changes to These Terms
We may update these Terms from time to time. We will update the effective date above when we do. Continued use of the Site after updated Terms are posted constitutes acceptance of the revised Terms. For material changes, we will make a reasonable effort to notify users via a notice on the Site.
